GENERAL TERMS AND CONDITIONS (GTC) OF KITAG CONCERNING THE CARTE BLEUE AND FOR USE OF ONLINE AND MOBILE SERVICES
These GTC govern the cashless purchase using the Carte Bleue of kitag cinema tickets having a countervalue equal to the respectively valid admission prices and of cinema coupons offered by kino-theater ag (hereinafter, “kitag”). The Carte Bleue is the customer card issued by Swisscom (Switzerland) AG (hereinafter, “Swisscom” or the “Card Issuer”). In addition to these GTC, the General Terms and Conditions of Swisscom for the Carte Bleue are applicable to the Carte Bleue (hereinafter, the “Customer Card”). In the event of discrepancies, these GTC take precedence.
The Customer Card is valid in all kitag cinemas in Switzerland.
With the Customer Card, any number of admission tickets may be purchased for all regular screenings. Upon payment of an annual season ticket fee and opening of a personal online account with the customer card or its addition to an existing online account (activation of the season ticket), the customer card discounts are applicable in the year of the season ticket concerned for all regular performances, with the exception of specific performances designated by kitag – whereby no more than ten tickets may be obtained for any given performance in the year of the season ticket concerned – and for the kiosk discount. The applicable provisions concerning minimum age requirements must be observed in all cases. If the annual subscription fee is not paid, or if the annual subscription is not activated, the Customer Card is considered to be a Customer Card without subscription. No discounts are granted with the Customer Card (with or without subscription) for tickets and seats with additional offerings. In any event, a premium is charged for 3D screenings. In addition, tickets must always be purchased with the Customer Card. Customer Card price discounts may not be combined without other price rebates (AHV, etc.).
New customers may obtain the Customer Card only with subscription at the current terms. The minimum subscription period is one year and may be renewed by the cardholder for successive one-year periods. The subscription year begins upon successful activation. If tickets reserved with a Customer Card are picked up at the ticket window, the Customer Card must be presented and the tickets paid for entirely with the credit on the Customer Card. If the balance is insufficient to purchase the reserved tickets, the Customer Card must be topped up with at least CHF 30.00 (minimum amount). The maximum amount that can be topped up is CHF 300.00. This also applies to the purchase of cinema coupons.
The Customer Card without subscription is valid without expiration. In the event that the Customer Card (with or without subscription) is misused, kitag and the Card Issuer assume no liability whatsoever to the cardholder or third parties. The Customer Card can be blocked, made unusable for third parties and replaced for the lawful owner only if upon purchase the name and address of the owner, as well as the Customer Card number, is disclosed to kitag (Priority Club (bonus system), personal Internet account). If a registration in the Priority Club is made, or if a personal Internet account was opened, the Customer Card is replaced in the event of loss or damage in exchange for a processing fee. If the debiting of the Customer Card with the replacement fee leads to a negative balance, the Customer Card must be topped up with the minimum amount at the ticket window or on the Internet. The design of the replacement card is determined by the Card Issuer. In the event of failure to comply with the provisions concerning minimum age requirements, the credit topped up on a Customer Card, the card or subscription fee, and ticket prices are not reimbursed. The validity and value of the Customer Card may be queried at all kitag ticket windows, using the Carte Bleue app for iPhone or at kitag.com. The bonus system is applicable only if the cardholder is registered in the Priority Club. Priority Points may be collected only with cinema admissions for screenings for which a Customer Card price discount is granted.
Kitag is entitled to use the customer’s personal data for its own advertising and marketing purposes and to disclose such data to partner companies marketed on kitag.com, including Swisscom, for the purposes of advertising their products. The customer can at all times review and correct the data relating to him or her via the personal Internet account or by submitting a written request to kitag, as well as to prohibit the disclosure and use of his or her data for advertising purposes by submitting a written declaration to kitag (kitag kino-theater ag, Löwenstrasse 11, 8021 Zurich).
Kitag reserves the ability to revoke the Customer Card at any time against disbursement of the remaining credit. Any type of misuse of the card or data entitles kitag and the Card Issuer to revoke the Customer Card without replacement and to close the personal Internet account of the relevant customer. By ordering or using the Carte Bleue, the customer acknowledges these GTC. kitag reserves the ability to amend these GTC at any time, as well as to modify or end the Customer Card, online and/or mobile offer. The Special Terms and Conditions of kitag are applicable to the use of online and mobile services. These Special Terms and Conditions apply in supplementation of the above GTC to the use of online and mobile services by holders of the Customer Card and by customers (hereinafter, “Users”). Users must correctly record data when using online and mobile services. The use of invented names and pseudonyms is prohibited. A personal Internet account must be opened in order to make use of the benefits associated with the Customer Card with subscription (Customer Card with activated subscription). A Customer Card is a prerequisite for making a reservation via the Carte Bleue app for iPhone (with activated subscription), as well as at kitag.com (with or without activated subscription). In this regard, Users offer to enter into a contract when they send their ticket order electronically. In general, purchased tickets and coupons may not be returned or exchanged. All accessed online and mobile services are attributed to the relevant User. Users are to take the requisite precautionary measures in order to keep their password secret and prevent use by unauthorised parties or misuse. With regard to purchased and home-printed Print@Home tickets and Print@Home coupons, as well as with regard to mobile tickets, Users must ensure that their tickets and coupons are protected against misuse (e.g. copying, changing or printing by unauthorised parties). Purchased tickets and coupons may not be used for commercial purposes. Print@Home tickets and coupons must be kept in such a way that all information on the ticket or coupon remains legible, particularly the bar code. As with traditional tickets, Print@Home tickets and mobile tickets must be presented when being admitted to the screening. kitag is entitled to use the User’s personal data for its own advertising and marketing purposes and to disclose such data to partner companies marketed on kitag.com, including Swisscom, for the purposes of advertising their products.
